So youre likely thinking this is insane and who has that much time on their hands to figure out all of this just for an image on a blog? In reality, though, answer question 1 of the 4-part fair use test and youre likely to get a very good sense of whether youll have a leg to stand on if challenged.

#1: Do you understand the term fair use? Just because you provide attribution and/or a link back to the original doesnt mean youre free and clear. Fair use has nothing to do with attribution. Thats an issue related to plagiarism, which is different from copyright.

Fair use basically means youre allowed to infringe on someones copyright and they cant do anything about it. If your use is covered by fair use, you dont have to provide attribution anyway .

#2: Why are you using the image? If it is for purposes such as criticism, comment, news reporting, teaching , scholarship, or research youre on the right track.

If youre just using the image to pretty up a post, then think twice or better yet, get permission or buy a stock image.

#3: Have you transformed the image? If the new work which incorporates the copyrighted image is a transformative workwhat you created no longer resembles the originalthere is a greater likelihood of finding an exception to copyright infringement.

Are you taking an image and incorporating it into an infographic? Is the image now part of a video used for one of the reasons set forth in the Copyright Act?

What Is Fair Use

Fair use is a doctrine originating in U.S. law that permits limited use of copyrighted material without permission from the copyright holder. The copyright limitation is intended to balance the interests of copyright holders with the public interest by allowing certain limited uses that could otherwise be considered infringement.

U.S. courts have cited as examples of fair use such as commentary, search engines, criticism, parody, news reporting, scholarship and research. Unfortunately, the doctrine still leaves a giant gray area and there is never a guarantee that your use will qualify as fair. In fact, the only way to get a definitive answer on whether or not a particular use is fair is to have the issue resolved in court.

The qualify as fair use, courts examine four criteria:

  • The purpose and character of the use, including whether it is of a commercial nature or for nonprofit educational purposes
  • The nature of the copyrighted work courts grant more leeway to copies of factual works such as biographies than from fictional works such as plays or novels.
  • The amount and substantiality of the portion used in relation to the copyrighted work as a whole sometimes the amount of material copied is so small the court permits it without even conducting a fair-use analysis.

    • 1The copyright status applies to the creative work, e.g. the computer file that stores the logo. The word Marvel and perhaps the lettering style is trademarked, though. For example, you could create your own drawing of the Marvel logo and that would be copyrighted to you, but it would still be the Marvel logo it would be still be someone else’s trademark.

    No, it is certainly not legally safe to sell a shirt with such an image printed on it. There are two compatible facts to consider:
