Things To Think About Before Using Copyrighted Images

Public Domain Images 100% FREE For Commercial Use | for Redbubble, Etsy, Amazon & any POD | 2021

So youre likely thinking this is insane and who has that much time on their hands to figure out all of this just for an image on a blog? In reality, though, answer question 1 of the 4-part fair use test and youre likely to get a very good sense of whether youll have a leg to stand on if challenged.

#1: Do you understand the term fair use? Just because you provide attribution and/or a link back to the original doesnt mean youre free and clear. Fair use has nothing to do with attribution. Thats an issue related to plagiarism, which is different from copyright.

Fair use basically means youre allowed to infringe on someones copyright and they cant do anything about it. If your use is covered by fair use, you dont have to provide attribution anyway .

#2: Why are you using the image? If it is for purposes such as criticism, comment, news reporting, teaching , scholarship, or research youre on the right track.

If youre just using the image to pretty up a post, then think twice or better yet, get permission or buy a stock image.

#3: Have you transformed the image? If the new work which incorporates the copyrighted image is a transformative workwhat you created no longer resembles the originalthere is a greater likelihood of finding an exception to copyright infringement.

Are you taking an image and incorporating it into an infographic? Is the image now part of a video used for one of the reasons set forth in the Copyright Act?

Creative Commons Public Domain Tools

  • CC0 is a public domain dedication that allows copyright holders to place works in the public domain to the extent legally possible, worldwide.
  • CC’s Public Domain Mark allows anyone to mark a work that is already free of copyright restrictions around the world.

See for more information on CC’s public domain tools.

Public domain content in practice is any content without copyright. It may be freed from restrictions by the copyright, or the copyright may lapse after a certain time.

The details in practice vary between countries. More information about public domain can be found at Wikipedia’s article on the public domain.

What Is Fair Use

Fair use is a doctrine originating in U.S. law that permits limited use of copyrighted material without permission from the copyright holder. The copyright limitation is intended to balance the interests of copyright holders with the public interest by allowing certain limited uses that could otherwise be considered infringement.

U.S. courts have cited as examples of fair use such as commentary, search engines, criticism, parody, news reporting, scholarship and research. Unfortunately, the doctrine still leaves a giant gray area and there is never a guarantee that your use will qualify as fair. In fact, the only way to get a definitive answer on whether or not a particular use is fair is to have the issue resolved in court.

Checklist by Kenneth D. Crews and Dwayne K. Buttler, available under a Creative Commons Attribution license

The qualify as fair use, courts examine four criteria:

  • The purpose and character of the use, including whether it is of a commercial nature or for nonprofit educational purposes
  • The nature of the copyrighted work courts grant more leeway to copies of factual works such as biographies than from fictional works such as plays or novels.
  • The amount and substantiality of the portion used in relation to the copyrighted work as a whole sometimes the amount of material copied is so small the court permits it without even conducting a fair-use analysis.

Images appearing on social media are no different than any other image youll find online, in that you must act responsibly and ask for permission.

Lets say you have a customer that posted an amazing image of your product on Instagram and youd like to use it sending a simple direct message asking for permission is quick and easy, and will protect you and chances are youll get a yes.

    How Do The Licenses Work

Check out this infographic by adityadipankar for a quick intro to the various types of Creative Commons licenses. If you are interested in learning more about these licenses, CreativeCommons.org offers more information.

All Creative Commons licenses require attribution to the creator. If you are interested in more information about best practices for providing attribution, Creative Commons Australia has created a handout with detailed information about proper attribution practices.

How Do You Know If Something Is In The Public Domain

Works can be part of the public domain in three instances:

    • Their copyright has expired. In the United States, any work published anywhere in the world prior to Jan. 1, 1923, is in the public domain. Other countries may follow different policies on length of copyrights.
    • They were released into the public domain by the copyright holder. In such cases, the copyright holder needs only release their work with an accompanying statement releasing all rights to the work. Images licensed under the Creative Commons CC designation are released to the public domain.
    • They are ineligible for copyright protection. In the United States, works created by a government agency are not eligible for copyright protection and can be used by the public. Content that does not rely on human creativity is also ineligible for copyright. A list of bare facts will belong to the public domain, while an article based on those facts and an infographic referencing them are both copyright protected.

    What Are Public Domain Videos

Public domain videos can be film clips, home movies, commercials, newsreels, or any kind of video footage that is available to anyone, free of charge. These videos have no copyright, either because the copyright expired, or it never had one to begin with.

Sometimes a creator purposefully forgoes copyright protection, intending for their work to be public domain from the start. The Creative Common Zero License is attached to these videos and means they can be distributed, copied, and used for commercial or personal use without asking for permission or attribution.

Any video created by a government is considered public domain.

Even if a video is labeled as public domain, there could be caveats. For instance, a famous person should not be used to endorse a product without permission, even if that person is no longer alive. The same applies to using footage from a government entity while you can use the footage in a commercial, it should not look like the government entity endorses your product. Also, if using a public domain video with art or music that has not been cleared, you could still face legal hassle.

I searched for public domain images on Wikipedia for my t-shirts. Here is an example public domain image. The permission section for the image says:

This image consists only of simple geometric shapes or text. It does not meet the threshold of originality needed for copyright protection, and is therefore in the public domain.

So is it really safe for me to use that image for commercial purposes? If no, why they call it a public domain image?

    • 1The copyright status applies to the creative work, e.g. the computer file that stores the logo. The word Marvel and perhaps the lettering style is trademarked, though. For example, you could create your own drawing of the Marvel logo and that would be copyrighted to you, but it would still be the Marvel logo it would be still be someone else’s trademark.

No, it is certainly not legally safe to sell a shirt with such an image printed on it. There are two compatible facts to consider:

  • Wikipedia is correct that the image is not covered by copyright in the United States.
