If they are using your trademark or deliberately passing themselves off as being related to your business, you have a strong basis for using a dispute resolution procedure or taking court action against them.

If they can claim they are using the domain legitimately, it may be more difficult to take action. Rather than spending time and money on a dispute, you might be better off focusing on promoting your own domain name. How To Get My Domain Name Back After It Has Expired

Assuming the domain has not been picked up by a third party, we can assist you in getting your domain name back.

The process of domain rescue has the following fees charged by the domain registry.

  • Local domain, i.e. CO.ZA or .ORG.ZA, expire but fall within the stipulated grace period, a Domain Rescue fee of R50.00 will be applicable upon the domain successfully being retained after the expiration thereof.
  • Local domains, i.e. CO.ZA or .ORG.ZA, expire and fall outside the stipulated grace period, an additional Domain Redemption fee of R500.00 will be charged to retain the domain after the expiration.
  • International domain, .COM, .NET and .ORG, expire but fall outside of the stipulated grace period, a minimum Domain Redemption fee between $89 and $300 will apply if the domain is retained after the expiration thereof.

Whois Public Domain Info

WHOIS is a database that stores public information on a domains registered users in a way that can be easily read. It basically tells you who is responsible for a domain. Many online registrars will allow you to access and search the WHOIS databases. I use the Godaddy lookup out of habit but any of them should work just fine.

WHOIS will also give you the registrant name of the individual who registered the domain. Now youll be able to know if it was an old web designer, a business partner, or even yourself who set it up. Youll also find the date of creation and expiration date. With this information you can hopefully contact the person who registered it and have them transfer the domain to you. And we all live happily ever after!

If you need to recover a domain account where you lost the password, the WHOIS info will often give the registrant email address which will help you in recovering a password and login from the domain registrar.

Note: Keep in mind that some domain owners pay for privacy to hide the public WHOIS information and provide only proxy info. In that case, youll be out of luck and may just need to wait for the domain to expire so you can register it yourself

If you believe a domain name infringes on your copyright or trademark, contact the owner of the domain or file a UDRP claim or court proceeding.

Youll need to file a complaint, being careful to communicate it in as many ways as possible. Choose an Internet Corporation for Assigned Names and Numbers -approved provider to oversee administrative proceedings, and be prepared to show evidence of trademark or copyright ownership on your part and bad faith on the part of the accused domain squatter.

Most domain registrars offer a 20-30 day period for domains that are expired before placing them into an auction. Note that the rules between domain name registrars may vary when it comes to reclaiming lost domain names.

If less than 20 days after the domains expiration date, try contacting the domain registrar. They often offer assistance to reclaim and renew the lost domain name.

However, the cost of reclaiming the lost domain will not be at the annual renewal rate, so expect to pay roughly around $100 or so to reclaim the lost domain name.

If the domain has gone to auction, youâll have to participate in the expired domain auction. Get ready to hope and pray to outbid others at a reasonable price, not outside your budget.

I am slightly paranoid about my domain name I have. I think the site I am building could have potential and take off in the future. I am worried though if the people I registered the domain name with might try and extort more money off me or take away my domain name for themselves.

When a domain name is registered, the registrant acquires the right to use, renew, restore, or transfer the domain name. Quite often I have clients contact me wanting to get an existing website recreated who have no idea who owns or registered their domain name.

There are so many people who do not register their own domain names and instead allow third parties such as web developers and IT support agencies to do this for them. Never do this, always register your own domain names so you have full administrator access. Its much easier to share access with third parties than it is to try and regain access from them if circumstances change.

Two common issues arise when a domain is registered with a third party as follows:

  • The domain can be left to expire which means all linked services go down instantly and there is the potential for someone else to then get their hands on your domain.
  • The second problem is making changes to the domains DNS settings if you want to get a new hosting or email provider.
